This disclaimer applies to the CRAYON-C4 service (the “Service”) — the web application, documentation, command-line tools, and editor extensions we provide. By using the Service you accept this disclaimer. If you do not agree with it, please do not use the Service.

1. Service provided “as is”

The Service is provided on an “as is” and “as available” basis. We work hard to keep it reliable, but we do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. Features may change, be suspended, or be withdrawn at any time.

We are not responsible for unavailability or degraded operation caused by events outside our reasonable control, including failures of hosting, network, browser, or other third-party infrastructure.

2. Your data and your backups

You are solely responsible for backing up your work. Keep regular, independent copies of your projects outside the Service — for example by using the built-in export features to download your project files — and verify from time to time that those copies can actually be opened and restored.

Local (free) projects are stored only in your browser’s local storage on your own device. We never hold a copy. Clearing browser data, reinstalling or updating your browser, using private/incognito mode, or losing the device can permanently and irrecoverably destroy local projects.

Cloud projects keep version snapshots as a convenience feature — not as a backup service. Snapshots are retained for a limited period only: you should assume that restore points older than 7 days are not available. The retention window may be changed, reduced, or discontinued at any time without notice.

Although we perform routine operational backups of our systems, we do not guarantee that your data will never be lost, corrupted, or become unavailable. To the maximum extent permitted by applicable law, we accept no liability for loss or corruption of data where you have not maintained your own independent backups.

3. Data retention and account termination

When your subscription ends or your account is deleted, your cloud data may be permanently deleted after a limited period. Export your projects before cancelling a subscription or deleting an account. Deleted data cannot be recovered once removed from our systems.

4. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits, lost revenue, business interruption, or loss of data — arising out of or related to your use of, or inability to use, the Service.

Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the claim, or €100 if you have paid no fees, whichever is greater.

The Service relies on third-party providers — including hosting, authentication, payment processing, and email delivery. Those services are governed by their own terms and privacy policies, and we are not responsible for their availability or conduct.

6. No professional advice

Diagrams, documentation, and examples produced with or provided by the Service are for informational purposes only. The Service does not validate the correctness, security, or fitness of your architecture; decisions you make based on content created with the Service are your own responsibility.

7. Your statutory rights

Nothing in this disclaimer limits or excludes any statutory rights you have as a consumer that cannot be limited or excluded under applicable law. If you are a consumer in the European Union, you retain all protections afforded by EU consumer law.

8. Changes to this disclaimer

We may update this disclaimer from time to time. The “last updated” date above reflects the latest revision. Continued use of the Service after a change constitutes acceptance of the updated disclaimer.
